This book examines the roles and interconnections between structural factors and individual agency in marital violence, focusing on women in heterosexual marital relationships. With the overall aim of improving recognition and strengthening responses to marital violence, it underlines what occurs as marital violence and why it is possibly occurring in the manner it does, while simultaneously demonstrating how it is dealt with and resisted.Based upon in-depth qualitative data focussing upon the experiences of women facing marital violence and key informants from Assam in Northeast India, this book sheds light upon four key areas. To begin with, what is named or recognised (and not recognised) as marital violence is assessed and a typology (and associated denials) informed by the capabilities approach is developed. Further, the re-victimization that happens through and within both civil and criminal justice is explored. To conclude, conditioned by distinct material-cultural constraints-enablers and acknowledging the role played by emotions, a temporal agential trajectory in response to marital violence is mapped, specifically through the concepts of Habitus and Reflexivity. This book aims to recast the way that philosophers understand rhetoric. Rather than follow most philosophers in conceiving rhetoric as a specific way of speaking or writing, it shows that rhetoric is better understood as a dimension of all human discourse and action--what the author calls "rhetoricity".This book provides the first philosophical treatment of rhetoricity. It is motivated by two ongoing developments. The first is the debate between Alain Badiou and Barbara Cassin about philosophy's relation to rhetoric. Both Badiou and Cassin are critical of rhetoric, albeit for different reasons. Second, there has been a growing resurgence of interest in rhetoric considering the recent rise in authoritarian politics as well as new forms of propaganda driven by "persuasive technologies". This book identifies the common target of Badiou's and Cassin's otherwise incompatible critiques: rhetoric's conception of audience. It offers a fresh take on the "new rhetoric" project of Chaïm Perelman and Lucie Olbrechts-Tyteca, putting their work into conversation with the Badiou-Cassin debate. This book examines one of the most pervasive and successful dramatic tropes of the Restoration and early eighteenth century: sexual violence.During this sixty-year span, there were over fifty tragic and tragi-comedic productions that showcased rape and/or attempted rape--a remarkable number that was unprecedented in English dramatic history. Rape was not merely depicted more frequently during the Restoration, but it was also placed at the center of more plots, given more pathetic emphasis, and even staged more centrally. Restoration dramatists were the first to revolve routinely entire plots around the rapes of their innocent heroines, to give powerful voices to these heroines post-rape, and to imbue their sexually violent scenes with new and attention-getting staging techniques, such as discovery scenes. As this book argues, sexual violence emerged at this time as a highly flexible dramatic trope that could be used to illustrate terrifying political scenarios, to elicit extreme pathos in audiences, and to demonstrate the bearing lost chastity had on social stability. The Class Gap in Protest Participation discusses a theoretically grounded empirical analysis of the relationship between class and protest involvement across Central Eastern and Western Europe.In recent decades, mass protests have surged in both frequency and scale, yet there remains significant variability in citizen involvement in non-electoral politics across Europe. While affluent Western democracies often witness robust civic engagement, countries of Central and Eastern Europe exhibit comparatively limited political participation. This regional gap is particularly pronounced when examining post-socialist workers who show minimal protest activity. Addressing this phenomenon, the book starts from the following question: Why do workers in Central and Eastern Europe demonstrate disproportionately lower rates of protest engagement compared to their Western European counterparts? The study reveals that the answer lies beyond conventional explanations such as legacies of communism. Cross-regional disparities in working-class protest activism are driven by differences in labor protection and left mobilization capacity. It examines the nature of monarchy in the Malay world, which includes present-day Malaysia and Indonesia, before and during the onset of Western colonialism when the Malay world was ruled by a large number of separate Muslim sultanates. It highlights that monarchs were the highest authority in the social, political, legal and economic system, rather than the government of a clearly defined territory; the notion of Dewaraja (god-king) and what a model monarch's attributes should be; and how the monarch's role related to Islamic principles, including the Islamic ideal of the Caliph of God meting out fair judgement and punishment. Two prominent and pivotal concepts of traditional Malay society, that of daulat (sovereignty) and derhaka (disloyalty) are here analysed and evaluated against the background of the period of absolute monarchy. The author reconsiders the issue of the "comfort women", that is the Korean women who were compelled to provide sexual comfort to Japanese troops during the Asia-Pacific War. She explores the human complexity of the experiences of these women, who despite terrible exploitation, she feels, cannot and should not only be considered only as passive victims. She sets the issue in context, revealing how Korean society played a role, with patriarchy and middlemen being significant factors in the procurement of comfort women, and how alongside the comfort women there were volunteer labour corps of Korean young women supporting the Japanese war effort. She highlights Korea's colonial status, different from the territories Japan invaded and conquered, discusses how relations between colonisers and colonised in an empire are not straightforward, and argues that people should work to understand more fully the mindset of those at the time, and refrain from forcing values from the present to resolve indignities of the past. This book is the first comparative law study of collateral consequences of criminal conviction in all federally recognized Indian tribes in the lower 48 U.S. states, and the mechanisms for restoring civil rights in tribal law.Surveying the constitutions, codes, and ordinances of tribal jurisdictions reveals a broad range of consequences - the impact of which has not been comprehensively, and critically, examined. Like state and federal jurisdictions, tribal law attaches thousands of legal disabilities to tribal offices, business licenses and permits, social services, and civil rights for persons with criminal convictions. This is especially true in economically important industries such as gaming and resource extraction; additionally, rapidly changing areas such as marijuana regulation and sex offender registries expand the scope still further. This book catalogues restoration of rights procedures in tribal law, to include pardons, expungements, and record sealing. Collateral consequences have proliferated in tribal law because of the limitations of tribal criminal jurisdiction, including over non-tribal members.
