Die 11. Tagung zu »Literatur und Recht« im Nordkolleg Rendsburg beschäftigte sich mit dem ebenso spannenden wie unerschöpflichen Themenkreis Recht, Sprache, Kunst und Literatur mit ihren Ein-und Ansichten sowie mit aktuellen Debatten. In den Vorträgen ging es etwa um Äußerungsdelikte im Internet, Kunstfälschungsprozesse, die Rolle der Rhetorik im Recht, Humor und Recht, die möglichen Auswirkungen der #MeToo Debatte auf Musik und Recht sowie um Juristen und Juristinnen auf (kriminellen) Abwegen. Es war eine Tagung der Vielfalt. Das zeigt, dass das Thema quicklebendig ist und dass die Funken, die beim Aufeinandertreffen von Recht, Kunst und Literatur entstehen, in allen Farben und in alle Richtungen sprühen. Ein Fest der Freiheit des Denkens waren die drei Rendsburger Tage auf jeden Fall.

Arne Grøn's reading of Søren Kierkegaard's authorship revolves around existential challenges of human identity. The 35 essays that constitute this book are written over three decades and are characterized by combining careful attention to the augmentative detail of Kierkegaard's text with a constant focus on issues in contemporary philosophy. Contrary to many approaches to Kierkegaard's authorship, Grøn does not read Kierkegaard in opposition to Hegel. The work of the Danish thinker is read as a critical development of Hegelian phenomenology with particular attention to existential aspects of human experience. Anxiety and despair are the primary existential phenomena that Kierkegaard examines throughout his authorship, and Grøn uses these negative phenomena to argue for the basically ethical aim of Kierkegaard's work. In Grøn's reading, Kierkegaard conceives human selfhood not merely as relational, but also a process of becoming the self that one is through the otherness of self-experience, that is, the body, the world, other people, and God. Discourses of Heimat and of migration both negotiate questions of identity, belonging, and integration; moreover, despite the reemergence of right-wing, racist, and exclusionary uses of the term Heimat, there are in fact more recent German-language cultural texts that problematize and challenge a view of Heimat as a community that excludes the Other than there are promulgating it. This volume addresses the parallel proliferation of discourses of Heimat and of migration in contemporary German-language culture and demonstrates that the entanglement of migration and Heimat can be productive: it can help us to reframe what it means to have a home, to lose one, find one, or belong to one.

Citizens' Assemblies (CAs) are flourishing around the world. Quite often composed of randomly selected citizens, CAs, arguably, come as a possible answer to contemporary democratic challenges. Democracies worldwide are indeed confronted with a series of disruptive phenomena such as a widespread perception of distrust and growing polarization as well as low performance. What is economics' missing link? Recent economic crises have had a devastating impact on society. Worryingly, they gravely risked a collapse of the financial system. These crises also painfully revealed economics' blind spots. Crucially, economics is not an innocent bystander but central to the problem. In this pioneering book, Patrick Schotanus explains that economics' mechanical worldview is the ontological error which leads to flawed thinking and faulty practices. The Market Mind Hypothesis (MMH) thus calls it "mechanical economics" it not only erroneously views but also dangerously treats the economy as a machine, the market as an automaton, and its agents as robots. Inspired by heterodox economic and leading cognitive thinkers, this book offers an alternative paradigm. How can we portray the history of Renaissance knowledge production through the eyes of the students? Their university notebooks contained a variety of works, fragments of them, sentences, or simple words. To date, studies on these materials have only concentrated on a few individual works within the collections, neglecting the strategy by which texts and textual fragments were selected and the logic through which the notebooks were organized. The eight chapters that make up this volume explore students' note-taking practices behind the creation of their notebooks from three different angles. The first considers annotation activities in relation to their study area to answer the question of how university disciplines were able to influence both the content and structure of their notebooks. The volume's second area of research focuses on the student's curiosity and choices by considering them expressions of a self-learning practice not necessarily linked to a discipline of study or instructions from teaching. We need a new theory of money. The still-dominant theory of money as taught in intro textbooks is 100+ years old, and for almost that long we have known that it's totally wrong. The best alternative are "heterodox" accounts developed in the 90s and 00s. These are indeed better overall descriptions of money, but they remain incomplete and inadequate: they rely too much on why the orthodoxy is wrong, thereby incorrectly assuming there is only one alternative (so-called heterodoxy). Money has no value develops a new (more subtle, more sophisticated) theory of money. It takes more seriously than any other work to date, the depth and seriousness of the fundamental claim that all money is credit. Money is not a thing, but a marker of a social relation of credit and debt between two parties. Money is not value itself; no form of money (as money) ever possesses any positive, intrinsic value. Second, the book shows that not only is all money credit, but that in an important theoretical sense, all credit is money to the extent any credit/debt between two parties has the potential to be transferred to another party (thereby functioning as money). Finally, the book links this radical credit theory of money to today's concrete money practices: this includes global capital flows, national and international monetary policy, and most of all the daily turnover in the money markets. The book therefore develops the needed conceptual framework to ask questions like: what is going on with Bitcoin (much less GameStop) in 2021.

For fifty years the philosophy of language has been experiencing a stalemating conflict between the old descriptive and internalist orthodoxy (advocated by philosophers such as Frege, Russell, Wittgenstein, Strawson, and Searle) and the new causal-referential and externalist orthodoxy (mainly endorsed by Kripke, Putnam, and Kaplan). Although the latter is dominant among specialists, the former retains a discomforting intuitive plausibility. The ultimate goal of this book is to overcome the stalemate by means of a non-naïve return to the old descriptivist-internalist orthodoxy. Concerning proper names, this means introducing second-order description-rules capable of systemizing descriptions of the proper name's cluster to provide us with the right changeable conditions of satisfaction for its application. Such rules can explain how a proper name can become a rigid designator while remaining descriptive, disarming Kripke's and Donnellan's main objections. In the last chapter, this new perspective is extended to indexicals in a discussion of David Kaplan's and John Perry's views, and of general terms, in a discussion of Hilary Putnam's externalism.

For Kierkegaard the most important thing in life is to become a single individual or a true self. We are all born as human beings, but this makes us only members of a crowd, not true selves. To become a true self, we must transcend what we are at any given time and orient ourselves to the possible and to the actuality of the possible, to which all that is possible owes itself. True selves exist only in becoming, they are fragile, and that is their strength. They are not grounded by their own activities, but in a reality extra se, the flip side of which is a deep passivity that underlies all their activity and allows them to continually leave themselves and move beyond their respective actualities toward the new and the possible. Therefore, without the passion of possibility, there is no truly single individual. This study of Kierkegaard's post-metaphysical theology outlines his existential phenomenology of the self by exploring in three parts what Kierkegaard has to say about the sense of self (finitude, uniqueness, self-interpretation, and alienation), about selfless passion (anxiety, trust, hope, and true love), and about how to become a true self (a Christian in Christendom and a neighbor of God's neighbors).

This is the first translation into English of early phenomenologist Hedwig Conrad-Martius' Metaphysical Conversations, originally published in 1921. Conrad-Martius was one of Husserl's first students, an important part of the Göttingen Phenomenology Circle and mentor to Edith Stein, Jean Héring, and other early phenomenologists. The present volume provides the full German and English texts of the conversations, a phenomenological discussion of the nature of the human, examining the nature of body, soul, and spirit, and drawing distinctions between plants, animals, humans, and various other beings. The volume also includes two important essays on phenomenology, in which Conrad-Martius distinguishes between the phenomenological approaches of Husserl, Heidegger, and the more ontological approach of the Göttingen school of phenomenology. She is critical of Husserl's "transcendental" and Heidegger's "existential" approach. The conversations illustrate her use of the phenomenological method for fundamental investigations into the nature (or Wesen) of things.
